I’m looking at a Mazda Miata for sale in my area and am very interested in buying it. However, the car does have an aftermarket cold air intake. Is this a deal breaker? Thanks

No, it is not a deal breaker but you should pay attention to the oder mods (if it has any) and as always, have your mechanic check the car before purchase.
Subtract the cost of returning the car to the stock intake system from your offer price on the car. Makes me wonder what else they screwed up on the car.
The presence of a cold-air intake should immediately spark other questions: 1.) Was the ECU tuned to make the most use of the cold-air intake?; 2.) were there other mods performed?; 3.) was the vehicle beaten the heck out of?; 4.) is the engine worn?
You will need a mechanic to throughly check it out and confirm the rest of the vehicle is functioning as it should and engine is not worn (perform a dry/wet compression test).
