Hi Scotty,

On one of your older videos I remember you mentioned about used car dealerships being legally required to fix a car they sold if it has repair problems they should of known of - as they are car repair people. And a private seller could claim they were not aware of mechanical problems and not have to pay. Of course the lemon law is for new cars. I remember you said car dealers are bound by a law or rule to do the repairs if they are registered/ licensed as a legitimate car dealership. What is the law/ requirement you meant for the used cars? I watched many of your videos and do not know now which one it was. In the past I had a Ford dealership tell me the car is sold as is. I want to know how to have them do the repairs, what rule/ law I can use? Thanks.

Every state has different laws.  You need to research yours.  Unless you have some kind of written warranty (with 20 pages of exclusions) you are probably SOL.

As a dealer, I can tell you in Texas there is no warranty expressed nor implied on vehicles sold as is. One of the papers included in the sale is called a "We Owe", which states exactly what the responsibility of the dealership is for repairs. On As-Is sales, this form gets the word "None" or "Nothing" written on it and is signed by both parties.

This is why mechanic inspections are so highly recommended. Now, I have had customers complain about certain things after purchase (literally the tire pressure being too low for their liking despite being inflated to spec, creaks or rattles in the old classic cars, etc.). I have repaired issues for free after the sale as a show of good faith and appreciation, but you can't expect other dealers to do that. Especially the large chain dealerships.

As Doc said, if you really want to know then research your state law. It should be on the internet, or get a free consultation from a lawyer.

Usually, they cannot sell a vehicle that is unsafe to drive. But you still need to catch these things BEFORE you hand over your money. You will have a much more difficult time making this argument after the sale.
