I have a 2001 Chevy Malibu 3.1 v6, it’s got 78,000 miles and has been my daily driver without any problems for over a year but when it’s cold the E brake like will turn on and stay on for a while, could it be my drums going out?

Drums going out, no.....
The cable might have seized up.....have it looked at.....

The cable needs to be replaced.
