Summary: Since it is an issue with all of them produced allegedly, the issue is a design defect which means the case should favor GM.

These class actions are just battles for money. The only winners in this arena are the lawyers (on both sides).


Absolutely true. Even when class action suits are won, the plaintiffs get what...usually like $4 or something? It is a ridiculously low amount. The lawyers, meanwhile, clean house so of course they are all for it. Good to know someone else noticed these things.

I’ve been telling people I know for a while to avoid the GM 8-speeds at all costs.

I keep seeing a pattern with GM and that is they don’t stand behind their products.  Unfortunately, I own 2 GM products (2004 Corvette and 2009 Hummer H3) and my next purchase will be non-GM product.


don't confuse these grand litigations with actual interaction an owner would have with the company


Yeah I don't plan on buying any GM products from 2015 on...unless their a stick shift and even then I would hesitate LOL!
I have a 2003 Hummer H2, 2001 Camaro SS Conv and 2003 Chevy SSR. They had their problems but its not the engine nor trans fer sure..!! Yeah..I dunno..GM with all its recalls....especially that Cobalt fiasco...with the ignition switch...Just unthinkable how they handled THAT! and now this!


Even their pushrod V8’s (LT1, LT4 come to mind, along with the pickup truck V8 derivatives) have had issues (lifters, valve springs, cylinder deactivation mishap, etc.) and those can’t be fully trusted, even when paired with a manual.

Typical GM. They always get away with it. Just like the ignition key issues and other problems.

 

However, @mountainmanjoe is right. All car companies are dodgy, especially Dodge. Lol. Sorry, had to.

 

But IMO GM is the worst*.

Even worse than Fiat? You may be correct actually now that I think about it they have one of the most awful reputation to use technicalities to void literally everything in the corporate world.


they recalled the faulty ignitions. There are other things they SHOULD have recalled though IMO. Like whats up with all the peeling paint.

GM is recalling vehicles almost every week for completly different reasons like engine transmission body literally anything you can think about it is so sad the government helped this company out and ate the money of consumers.


No, not every week. Several per year. Just like all the car makers. I don't remember any body recalls. The government bailed out all the auto makers because it would be quite the catastrophe if they didn't. I understand they paid the money back.


@kerem you like doing this kind of research. Maybe you could make a list of all the recalls announced between 2015 - 2020, and then tabulate some results.


I see what you mean. I said every week because major news about GM (including recalls) happened on dates: Jan 11, Jan 5, Dec 25, another Dec 25, Dec 21, etc. No one can deny that is not what you would call quality.

Recalls spiked in 2014 for some reason for GM, %3300 compared to 2013. Anyways I have to say almost all manufacturers are not doing well when it comes to recalls in 2020. Ford GM Chrysler Toyota Honda you name it all of them had many major recalls. Now I can wind down this topic;)

Thanks for the graphs and statistics and all that fun stuff that every American is very interested in before buying a 10 year old Cruze.


I don't know what Cruze you're talking about . Plenty of people here looking for old cars, but I don't know what that has to do with recalls either.

Anyway, there's an obvious problem here. One study shows recalls decreasing from 2000-2010. The other shows them increasing. That's how reliable internet information is, Kerem.


Most. Comments. Ever. Lol. Just kidding guys. A lot of good info here. That paint peel is insane! What was that on? Very interesting charts as well. I'm surprised that any would show a decrease as some makers, particularly GM and Ford, seemed to have a lot last year. Very interesting. I'll just never forget that when GM was sued by the families of those who died as a result of the ignition issues, they said, "Oh that's OLD GM. We are NEW GM so we are not liable." And they got away, literally, with murder.

@mod_man various vehicles with Blue, Silver or White paint. Worst cases are the blue Trax (in the photo), and white vans.


I didn't know they were having paint issues like that. Hope they get it fixed.


it was only certain years. I think it's history now.

There are many badly designed products out there. You can't sue companies just for making them (unless it it injures you and the company knowingly ignores it)

GM recalls are from dates: 28 Dec, 23 Dec, 23 Nov, 13 Nov, 4 Nov, 14 Oct........


GMC Sierra is the second most recalled vehicles ever, and in 2014, GM's total number of vehicles recalled in that year alone was 26 million, which raised the number of the whole entire auto industry for that year to 44 million. The number of GM vehicles recalled in 2014 and the continuing trend afterwards was %3300 higher than in 2013. Also, the top 3 most recalled brands in the first half of 2020 were Toyota, Honda, and Volvo. How weird can it get?

General Motors is looking to have a class-action lawsuit dismissed that alleges there are defects with its 8L45 and 8L90 eight-speed automatic transmissions.

The lawsuit, filed in the U.S. District Court for the Eastern District of Michigan, alleges GM’s eight-speed automatic transmissions may shift violently into gear. The filing claims the problems are caused by some type of hydraulic systems failure, which can wear down the gears and allow metal shavings to become caught within the transmission. GM has sent technical service bulletins to dealerships, which plaintiffs say are an indication the automaker has known about the defects since at least 2015. The lawsuit also claims GM’s suggested fixes, such as flushing the transmission system, are only a temporary solution.

GM claims the problems with the transmission do not fall under the factory warranty, as it is a design defect and not a manufacturing defect. According to GM’s motion to dismiss, which was obtained by Car Complaints, the automaker’s warranty is only for vehicles that have “a defect that is so basic it renders the vehicle unfit for its ordinary purpose of providing transportation.” It says the plaintiffs in this class action suit “make only conclusory allegations that their vehicles are ‘unfit for their ordinary and intended use,’ but allege only inconvenience and mild discomfort.

It also points out that no injuries or deaths have been attributed to the problem and that no one has stopped driving their vehicle completely due to the rough shifting issue.

Screw GM! I will never buy any of their vehicles because they are a dodgy company that makes  products that they don't stand behind. They're heading for BK again!

At least the Toyota and Honda corporations themselves are (more) honest and stand behind their products I agree with mountainmanjoe that the companies and dealerships overall are ALL dodgy.


@kerem looks at those complain lists you put together. I would say Honda has a solid place there. And I admit I haven't had to deal with Toyota as a company before, but I've talked to their salesmen and they're just as sleazy as anywhere else.

The company values can also be seen in the issues on those complaint sites. Toyota and Honda get major issues fixed in 1-3 years quickly and the corporation actually do strive for perfection of their products, though both are modernising with the market nowadays. Look at GM. The Chevy Cruze has had been a pile of junk through 2014, and consumer reports defined the reliability as "dodgy." It takes them more time to fix issues with their cars and the cars and consumers themselves which the whole business is about is no where near the top of their priority list.
This can also be seen in the stocks of both companies. GM is totally inconsistent going from 19 to 40 etc. for the last 10 years while Toyota has been steadily going up for 40 years now.
