'10 Honda Odyssey shutters when accelerating at 40mph

I have a 2010 Honda Odyssey EX-L with 176,008 miles. I bought it used less than a year ago. Occasionally it will start to shutter while accelerating once I reach right at about 40 mph. It stops if I let off the gas or if I accelerate past 45 mph. It doesn't always happen but it does it more often than not. I have an inkling it's not wanting to shift from 2nd to 3rd. According to the service records the only time the ATF has been changed was at 69,104 miles. I didn't get a carfax as I got it at a great deal, but now I'm wondering if it'll be worth the $40. I took the van to the local Honda dealer and all they suggested was a flush & fill of the transmission, but when I took auto mechanics in high-school I learned that a flush is a no no at such miles. So I'm wondering if I'll do more damage than good if I drain & fill at this point? And I've used Lucas for oil leaks and for power steering but never their transmission additive. TIA

Although not recommended, it would be worth to change the transmission fluid with OEM Honda fluid. Drain and Refill only. Retain the old fluid incase something goes wrong, you can always replace it back.

However, ensure that the shudder is from the transmission itself and not anything else. Several other things can cause a shudder. 

Thank you! What else could be causing the shudder? I ordered a new scanner with freeze frame so I can see what it's doing when it happens.

As Doc said. First get the Spark plugs changed. Majority of the rough idling and shudder occur from misfires.

Then clean air filter and use spray and clean maf.

If it still shudders chances are its the transmission. You can see the transmission struggle to move to the next gear.

Dirty air filter, fuel filter, MAF or MAP sensor, spark plugs, etc.

So the knock sensor wire has been chewed by a rodent, along with a list of other wires. 

Not your day to buy a lottery ticket.

No but it is time to buy one of the sound thingies
