I am replacing the CV Axel on 07 Silverado 1500 4x4 5.3L . The stub Axel is about an inch from being seated, it will not go in any further and will not come out. BUT it is engaged with the diff., when I turn the stub axel the other side CV Axel will turn with it along with the drive shaft, so am I correct in assuming that the differential is in working condition. I had taken the truck to a local mechanic to complete the job for me, he had the truck on the lift and told me I needed a new diff. We were under the truck and I reached up and turned the stub which turned the drive shaft and passenger side CV, by the look on his face I think he is lying to me, could someone set me straight. Also can the truck be driven, not using the 4 wheel drive, without the axel seated. Of course I want the 4 wheel operational but I gotta let to work too. Truck is kicking my butt right now.

Unless you have locking hubs, the entire drivetrain, including front axle, still turns whether 4WD is engaged or not. Don't drive like that.

@imperator what about removing the drive shaft

Is it an OEM axle? Sounds like it may have the wrong splines. Unless the splines on the differential are messed up and not separately replaceable it sounds very unlikely you need a new diff. (Normally differentials make a terrible racket if worn internally.)

On at least some vehicles the CV axle is what holds the front wheel bearings together, so if that's the case on yours you would not want to drive with the axle removed. (That's the way my old AMC Eagle was.)
