High fuel trims after head gasket replacement

I had my honda dealer replace the head gaskets on my 2007 honda pilot.  Since doing that work, the car never idled quite right.  After hooking up a scan tool, I found that the short term fuel trim was +10 % at idle when warmed up.  I used carb cleaner and found a vacuum leak at the lower intake manifold going into the engine.  I contronted the dealer with my findings and they told me that when the did the head gaskets they machined the heads and that the honda oem intake gaskets didn't fit right so they had to make their own.  They took the car back and put OEM honda gaskets on and now the fuel trims are worse because now the long term trims are 7 %, whereas before they were about 1%.  Sometimes the car idles a little rough when cold at startup and you can feel a bit of imbalance.  My only concern was that before taking the car into the dealer the second time, I scanned the code reader and found pending misfire codes for 2 cylinders.  The 1 year warranty on the work ends in December.  Now that they did the work twice and got worse results, what can I do short of filing some sort of small claims case?

Take the car to an independent mechanic and get an official report of the issue, then go to the dealer.
