Prius 2012 Brake booster failure with internal leak after 106 K miles. Service Code C1391.

Hi Scotty Toyota is claiming out of warranty because the car with only 106K miles is more 10 years old by few months (was placed in service on March 2012) and the dealer estimate $2K plus. Should have been a safety recall instead of service bulletin with 10 year limit as most of us did not drive much because of Covid 19. Can you help me if anything possible to reopen the service bulletin Thanks

There were several class action lawsuits against Toyota for this, some of which were consolidated into a single class action lawsuit a couple years ago.

It looks like it finally ended up as: "Toyota Hybrid Brake Litigation", (in the U.S. District Court for the Eastern District of Texas) and I think Toyota eventually entered into some sort of settlement agreement with those plaintiffs in exchange for the plaintiffs dismissing the lawsuit. (you can research it for the details).

Unfortunately, it's unlikely you'll be able to get any relief at this point since Toyota has spent a small fortune in attorney fees to fight against covering this repair beyond the warranty period and being that your car is over 10 years old with over 100,000 miles it would be pretty hard to prove that you specific case is due to a  design/manufacturing defect . (((even though it probably is)))

Since there has not been a recall it is not likely the NHSTA will help you as an individual. However, if they receive complaints from enough owners that might initiate a recall in the future. (I know this doesn't help your current situation.)

People already wrote the NHTSA and Toyota responded by extending coverage for this repair to 10 years, 150,000 miles (whichever comes first)

You might want to start by calling that number and pleading your case to them since you are so close to the 10 year coverage limit
