Used Kia Rondo manifold issue

Hey Scotty crew I think I have only one more problem left with my 2010 automatic Kia rondo with 146000km on the ODO. I bought it used and I already told the story of the car in a previous question but now I know what the private party was hiding from me when they sold me the car. they replaced the entire exhaust system except the manifold that attaches to the engine and on the rondo there is a catalytic converter on the manifold and it is one piece.  They or someone else managed to brake the flange on the manifold, they brought it to Canadian tire (a hardware / appliance / car repair type store here in canada) apparently they told canadian tire just to patch it up as good as they could and thats when they sold it to me. Now theres nothing i can really do about this, I'm not getting my money back and it was my fault for not seeing the issue but the manifold is almost a 1k in parts and labour.

My question is can I make canadian tire liable for the faulty patchwork done on the manifold and make the labour atleast or even the part fit under their warrenty cause theyre telling me the manifold came like that and they were told just to patch the part together with washers and exhaust cement as a temporary patch but that doesnt feel legal, how can you simply patch something that by law needs to function (the catalytic converter on the manifold) and then sell the car? Why would a corporation agree to take that liability knowing it would leak again not long after.

I dont know, do I have any movement in any direction here with getting someone to be responsible for this. I can afford the fix no problem but the fact that canadian tire can just say my warrenty doesnt matter because they were told to patch a broken manifold seems so ludicrous to me and unreasonable, not only is it toxic fumes climbing into my cabin but i would fail an emissions and noise test easily atm and I have no recourse? 

hopefully there are a couple canadian moderators who can help me, know the law when it comes to this but any help is appreciated.

You can try requesting the fine print on Canadian Tire service warranty and reading that.

If the terms were to "patch it up as good as they could" then they did as they were asked, and it ends there.

If I fix your sink and it leaks later, it's not illegal.

 

Exhausts are repaired with patches all the time. They don't always work. That's life.

thats fair, just sucks when you get duped but liked you said its life. i paid 3700 for the car so its not a huge drop in the bucket. My mechanic actually knew a muffler guy and took my car to him they did their own repair and its far better they actually created a function flange to fit the pieces together and it makes no noise!

but today came a new problem hopefully i can be helped here loool so many problems its sucks.

well now I drove the car about 60km and when i was waiting for a friend to move his car I backed up a bit heard the rumble and rattling noise when in reverse and then it seems like all the power in my car went out and my radio flickered and my engine shut off and wouldn't turn back on. now it cranks but doesnt start. im assuming its electrical, like a blown fuse cause of the flickering light or the distributer blew or the fuel pump but not sure. when they did the exhaust repair could it be possible they didnt attach something tight and it came loose or they didnt unhook the battery so it shorted out something?


It's possible. You should let them look at it.


My mechanic looked at the car and it was a blown fuel pump fuse - odd I drove the car for almost 100km and it didnt blow. if it was exposed wire wouldnt it have blown much more quickly after the manifold repair if they damaged the electrical wires?

so we switched out the fuse and the car works fine but im worried itll cut out again while im driving. could this be an issue with the fuel pump, should I replace it and a precaution?


It's possible. The pump could be overloaded. Has the fuel filter ever been changed?


Not sure if it has but i doubt it very much i recently changed the cabin air filter cause of a musty smell coming from the ac and it doesnt look like it was every changed or not for a long time. ill check that aswell! could the fuel filter be giving the pump a little more work cause i have been struggling a tiny bit on steep hills which tells me there is a fuel pump issue but hopefully not replace the fuel pump haha

If there are no shorted wires, it's a solid bet your fuel pump needs replacing.  By the way, when was the last time your transmission fluid and filter were serviced?
