My brother took his 2017 tundra limited to the dealership for a oil change in Georgia.
After getting the keys back and paying we went to leave the dealership, truck sounded awful long story short they forgot the oil.
so the solution they have is a 3 party rebuilt engine that they won’t work on or warranty and said Toyota does not make his engine anymore
or a new truck. So they will give me around 35k on a trade in and I pay the difference. And wait 2 months for the new one. They won’t find me a used truck because the market is “crazy”. With that said they will only give me trade in value for the truck they broke.

Whether or not the market is crazy is not your problem. They made a mistake, so they should pay for it. You might have to resort to arbitration or court to pursue this.
That being said, is $35k a good trade-in? See how much similar Tundras are selling for right now. If they agree to 0% financing, then this might not be a bad option. Just make sure you get good money for your current car. Remember, they owe you the value of an engine (~$5k).
They drove it from the service area to the parking lot, and we cranked it up for less then 5 minutes to realize something was Wong
35k is okay on trade in but I don’t see why it’s trade in value.

Be realistic with your expectations and demands. Give them a chance to help you and make things right. Of course you deserve compensation, but they may not give you exactly what you want. You may need to work within their limitations. It all depends on your negotiating skills and creativity. Try to avoid litigation if you can. That would be a deep drain on your resources and energy, which ultimately may not bear fruit, or be a valuable use of your time. Yes, talk to Toyota HQ first. If that doesn't work, try arbitration. Bear in mind that your truck may be perfectly usable as is, just with a bit more wear and tear on the engine.
You should not have to pay for anything. They screwed up and need to make things right and get you a new engine at no cost to you. Did they acknowledge it was their fault, and do you have documentation it was 100% them (in case you have to go to court)? I would also contact Toyota corporate - this is ridiculous.

They will give us a new engine but it’s a used rebuild 3rd party engine, with no history and Toyota won’t give it a warranty or work on it if something breaks.

It's the only answer to your question that pretty much guarantees a fair outcome for your brother. I wish you the best, and remember - they screwed up big time. If they don't want to supply you with a new truck, then they should've done the oil change properly.
They owe you a new truck for NO money. Tell them you're getting in touch with the local TV station, (that they advertise on) to do a story about dealership screw ups, That should be all the motivation they need to do the right thing.
Why not both? seek legal help, contact higher ups, and burn their reputation. If their rep does down the drain then it will cost em a whole lot more than just an estimate for 3rd party crap. I highly doubt that Toyota itself doesn't make the engines anymore. The dealer probably just doesn't want the work to be done.
I agree with @BruceREE. Hire a good lawyer, go up the corporate ladder, and be professional about it. Anything you do can come up in court, so don't give them any ammo. Just stick to your guns. They broke your truck, they owe you a truck. Anything less, involve a lawyer.
Get everything in writing and go up the Toyota chain of command. Dealers have to keep Toyota corporate happy, and if they don't, they don't get any cars to sell.

I can understand your frustration. A court will look at making you whole again. They should rebuild or replace the engine and give some type of warranty.
