It's unclear how that has happened, but unless you've hit the bottom of your car, it's likely the shop.
The kind of shop that'd put the wrong fluid (supposedly not to spec) would also probably cause such a mess...
The shop is denying that it is their issue
Of course they'll deny.
If they'd be the kind of shop to accept responsibility - they'd also wouldn't probably have gotten into this situation.
It's always the crap shops that find them selves dealing with stuff that you can't prove was caused by them.
BUT, even if you can't make them replace it - don't throw it away, find a junkyard unit (with a warranty that includes labor)

I have a 2004 Honda Accord V6 6-speed.
I had my transmission fluid changed at an auto shop, and one week later my transmission stopped working. It turns out there was a crack in the transmission and all the fluid had drained out. I looked back at my receipt and it said that they put in a much thicker fluid than was indicated (80W-90 instead of 10W-30), which is likely why the fluid drained out over the course of a week. The shop is denying that it is their issue, and say the crack just happened by coincidence.
